Property Week: Landlords must act reasonably when pursuing possession proceedings

The stay on possession proceedings has finally been lifted, however, the process is now longer and more complex that it was before the stay began. The Court has brought in additional steps, meaning there are more opportunities for landlords to make a procedural error, which could lead to the proceedings being adjourned or even struck out completely. Landlords should be extremely cautious about bringing possession claims in the County Court and instead, work with their tenant’s where possible in order to find a suitable way forward for both parties.
