The end of ‘Overall Arrangements’
A statement made by the Master of Rolls on 3 November 2021 has confirmed that the “Overall Arrangements for Possession Proceedings”, which first came into effect in September 2020, came to an end on 1 November 2021.
The Overall Arrangements were a thorn in the side of many landlords, but a useful and arguably much needed buffer for tenants once the stay was lifted in September 2020.
However, with society slowly opening back up, the balance between landlord and tenant in possession proceedings is returning to its pre-pandemic state.
With no more Review Dates, extra bundles Covid-19 Case Marking, or the unlimited time for the court to list a hearing date, possession proceedings are set to be cheaper for landlords and hopefully quicker.
To add to this return to normality, Practice Direction 55C will also be coming to an end on 30 November 2021.
This will mean that landlords will no longer have to make enquiries of their tenants as to how the pandemic has affected them, and make a declaration as to that knowledge in the particulars of claim or in a notice field and served before the hearing.
This will further reduce costs for landlords and ultimately put possession proceedings back to how they were before the pandemic.
