International succession structures
We provided succession structuring to an individual which involved the formation of non-UK trust structures including a Private Trust Company to hold assets across multiple jurisdictions. As part of this offering we worked with the family to create long term checks and balances within the structure and to assist with wider family governance.
Pre and post immigration structuring
Alongside US lawyers and accountants, we act as trusted advisor for Ultra High Net worth clients who recently moved to the UK from the US. Our advice has included reviewing the implications of the clients’ existing US trusts, restructuring these to minimise UK tax, the UK tax implications of the clients relinquishing their US tax status and the creation of new UK and offshore trusts and funds.
We were the lead advisers to the executors of a US citizen who was a long term UK resident with a non-UK form Will. The deceased had c.£12m worth of assets spread across the UK, US, France, Jersey and Monaco as well as a historic US Trust.
We not only coordinated the probate process across all jurisdictions and the claims for relief under multiple tax treaties to prevent double taxation from arising but used a dual UK/US registered charity to secure a lower rate of IHT in the UK.
Acting for European national wife in circumstances where the husband lived in a North American tax haven. Our experience in dealing with complex financial issues meant that, once we were satisfied that we had undertaken a thorough investigation of the husband and obtained sufficient disclosure, we took the step of “pausing” the court proceedings to have a private settlement hearing. After a full day’s hearing, we were able to successfully negotiate a very favourable settlement for the wife.
Investing in residential property
Acted for an American family investing in London. We assisted with introductions to insurance brokers, and also to interior architects to help them build a team to develop their property. Through our connections, we were also able to assist with introductions to educational specialists on schooling enrolment processes, and also immigration specialists to advise on residency matters. We worked closely with our tax department to ensure that the purchasing structure was tax efficient, taking into account inheritance planning too.
We are working with a high profile international business leader to write a post nuptial agreement that will structure his business assets and personal wealth in the event
of divorce. This is a highly complicated case involving multiple jurisdictions and requiring specialist tax and corporate law advice in addition to family law.
